Terms and Conditions

1. SCOPE
The following general terms and conditions apply exclusively to all orders in the version valid at the time of the order. We do not recognize any deviating terms and conditions of the customer unless we expressly agree to their validity. The text of these general terms and conditions can be downloaded and printed out.


2. CONCLUSION OF CONTRACT
Our information on goods and prices on the website is non-binding. The purchase contract is concluded when we confirm delivery of the goods. Confirmation of receipt of the order does not constitute acceptance on our part. Spelling and calculation errors entitle us to withdraw. We also have the right to withdraw if the ordered product is not available. In these cases, the purchase price already paid will be refunded immediately.


3. RIGHT OF WITHDRAWAL
The purchaser can cancel the purchase contract in writing (also by email) or by returning the goods within two weeks of receipt of the goods. To meet the deadline, it is sufficient to send the cancellation in good time. The cancellation must be sent to bestellung@autosol.de. If the order value exceeds € 40.00, we will reimburse the cost of the return shipment. We reserve the right to claim a reduction in value resulting from the use of the goods.


4. DELIVERY
The goods will be delivered promptly after receipt of your payment. Delivery will be made from the warehouse to the delivery address specified by the customer. If the goods are sent abroad at the customer's request or if the customer chooses a special shipping method, he must bear the additional costs incurred. In the case of delivery abroad, the customer will also bear any taxes and customs duties that may apply. Unless otherwise agreed, information on the delivery period is non-binding.


5. PAYMENT CONDITIONS
The customer can pay the purchase price in the shop by credit card or advance payment (bank transfer). If payment is made by bank transfer, the goods will be sent to you after receipt of payment in our account. If you pay by credit card, payment is made on the day of dispatch. If the customer defaults on payment, we are entitled to demand default interest of 5% above the basic interest rate of the Deutsche Bundesbank pa. If we can prove that the damage caused by the delay is higher, we are entitled to claim this. The customer is entitled to prove to us that we have suffered no or significantly less damage as a result of the delay in payment. The customer is only entitled to a right of set-off if his counterclaims have been legally established or have been acknowledged by us in writing. The customer is only entitled to exercise a right of retention if his counterclaim is based on the same contractual relationship.


6. RESERVATION OF TITLE
The delivered goods remain our property until all claims against the customer have been paid in full.


7. WARRANTY AND LIABILITY
If there is a defect in the goods for which we are responsible, the customer can either request that the defect be remedied or that a replacement be delivered. If we expressly refuse to remedy the defect/replace the delivery or if we are unable to do so or if the remedy/replacement delivery fails, the customer is entitled, at his discretion, to withdraw from the contract or to request a corresponding reduction in the purchase price.


The warranty period is two years from delivery. Unless otherwise stated below, any further claims by the customer are excluded, regardless of the legal grounds. We are therefore not liable for damage that did not occur on the purchased item itself; in particular, we are not liable for lost profits or other financial losses of the customer. Insofar as our liability is excluded or limited, this also applies to the personal liability of our employees, representatives and vicarious agents. The above limitation of liability does not apply to damage resulting from injury to life, body or health that is based on a negligent breach of duty by us or an intentional or negligent breach of duty by our representative or vicarious agent. The limitation of liability also does not apply if the damage is based on a grossly negligent breach of duty on our part or on an intentional or grossly negligent breach of duty by our representative or vicarious agent.


8. DATA PROTECTION
The customer has been comprehensively informed about the collection, processing and use of personal data under the heading "Data Protection" and expressly consents to this collection, processing and use.


9. APPLICABLE LAW AND JURISDICTION
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. The place of jurisdiction is Solingen, as far as legally permissible. These General Terms and Conditions remain binding even if individual points are legally invalid. In place of an invalid provision, the legally permissible provision applies.
